Terms and Conditions For Dump And Flatbed Rental

Payment
If providing a credit card, the customer agrees to pay the
full amount shown on the contract and charges that may
be incurred due to loss, damage or extension of rental
period. If paying by cash, debit or interac e-transfer, the
customer shall pay the full contract amount in advance in
addition to a $500 deposit. The deposit shall be refunded
to the customer less any expenses incurred due to loss,
damage or extension of the rental period once the trailer is
returned and the contract has ended. If the amount owed
at the end of the rental period exceeds $500, the customer
will be responsible for paying the remaining balance.
Permitted Use
a) The customer acknowledges that NighCo Trailer Sales
LTD has no control over how the trailer is used during the
rental period. It is the responsibility of the customer to
ensure that the trailer is used in a safe, proper and legal
manner. This includes, but is not limited to, ensuring
proper licensing and permits are possessed, ensuring that
safety features such as lighting and brakes are in working
condition, and only towing the trailer with a suitable
vehicle.
b) The customer is responsible for ensuring that the trailer
is in proper condition for use prior to and following the
rental period.
c) The customer is responsible for any costs associated
with repairing damage that may occur during the rental
period whether or not the damage is directly the fault of
the customer. This does not apply to ordinary wear and
tear.
d) The customer shall inform NighCo Trailer Sales as soon
as possible if the trailer becomes damaged, defective or
unusable.
e) The customer agrees that by signing this contract, they
accept full responsibility for the trailer during the rental
period regardless of who is operating it or where it is
located.
f) The customer shall not make any alterations or
modifications to the trailer. This includes repairs that
occur without NighCo Trailer Sales' knowledge.

 

Maintenance
The customer shall perform routine inspections and
maintenance where necessary. This includes but is not
limited to, applying grease, maintaining a charged battery,
checking fluid levels, checking for leaks, and checking tire
pressure.
Customer Liability
The customer is responsible for costs of repairs due to
damage caused during the rental period. If the trailer is
lost, stolen or damaged in excess of 40% of the fair
market value, the customer will be responsible for the fair
market value of the trailer.
During the rental period, the customer assumes all risk
associated with possession of the trailer. This includes, but
is not limited to, theft, personal injury, death, losses,
damage and destruction of property.
In the event of an incident, the customer must notify
NighCo Trailer Sales as well as the police (if necessary)
and customer's insurance carriers.
Insurance
The customer is required to maintain general liability
insurance of no less than $1,000,000. Proof of insurance
must be provided prior to the rental period.
Hold Harmless Clause
The Renter agrees to hold NighCo Trailer Sales LTD
harmless from any and all liability, claims, demands,
damages, costs and expenses, including reasonable
attorneys' fees, arising out of or in any way connected with
the use of the equipment or trailer rented under this
agreement, whether caused by the negligence of NighCo
Trailer Sales LTD or otherwise. The Renter further agrees
to indemnify and defend NighCo Trailer Sales LTD against
any and all such liability, claims, demands, damages,
costs and expenses.

Replacement Costs - Below are the amounts that the customer agrees to pay in the event that the following parts are lost, stolen or destroyed during the rental period. These are meant to serve as examples. The customer’s liability is not limited to these items.

Ramps: $400/ramp

Remote $80

Toolbox Key: $20

Pump: $1,000

Battery: $250

Tire: $250

Rim: $120

Coupler: $250

Mesh Tarp (Tarp only. Does not include crank, bearings, etc.): $200

 

Rental Costs

These are the rental costs for each trailer unless alternative pricing is agreed to in advance:

Cleaning Fee (Applies To All trailers):  $20 **waived if brought back clean**

Cancelation Fee: $50 **the card on file will be charged a $50 penalty for canceled reservations**
